NCC this week joined the U.S. Poultry & Egg Association (USPOULTRY), National Turkey Federation (NTF), numerous State Poultry Associations and poultry processing companies in submitting comments to the EPA on the proposed 2026 Multi-Sector General Permit (MSGP), which covers stormwater discharges from industrial facilities in areas where the EPA is the National Pollutant Discharge Elimination System (NPDES) permitting authority.

The poultry industry’s comments:

  • Outlined the ways in which the proposed revisions to the MSGP are overly burdensome and unnecessary;
  • Proposed alternatives to the burdensome requirements that are in line with requirements currently in place in certain states;
  • Highlighted areas where the MSGP may not be consistent with Loper Bright and other recent Supreme Court decisions; and
  • Requested an extension so that stakeholders can comment on how the comments align with the White House’s April 9th memorandum directing federal agencies to reconsider and rescind rules which exceed their statutory authority.
